Consumer commitment

Every consumer has the right to understand why and how their personal information is being used. Per the Fair Credit Reporting Act (FCRA), if you are the subject of a consumer report (background check) you have the right to dispute any information that you believe is missing or inaccurate. Additionally, have the right to request a copy of your report.

Total Insight Screening (“TIS”) is a Consumer Reporting Agency, as defined by the Fair Credit Reporting Act (15 U.S.C § 1681) (“FCRA”), of domestic information for processing background screening for employment or other permissible purposes under the FCRA or other applicable law.

At TIS We Have the Proper Channels in Place to Protect Your Rights, Including:

  • Policies and procedures to protect your PII (Personally Identifiable Information)
  • A process to dispute your background check results
  • Performing a reinvestigation at no cost
  • Providing a free copy of your background check
  • Updating your potential employer/user of the background check if a reinvestigation produces different results
  • Offering additional resources such as for identity theft remedies if applicable, and
  • Providing a real person on our Compliance Team to assist you through the dispute process

Requesting a Copy of Your Background Check Report

To request a copy of your report please contact us by phone, email, mail or fax. After confirming your identity by phone to protect your information, we will provide a report by email, fax or mail.

Verifying Your Identity

To protect the confidentiality of your personal information we will need to verify personal information including full name, date of birth, current address and the last four digits of your Social Security Number. We will also need the name of the employer/potential employer who ran your background check.

If you contact us in writing, please be sure to include all of the security information listed above.

Disputing Your Background Check Report

Although TIS has one of the lowest dispute rates in the country, if you believe information on your background check may be incorrect we are happy to review all of the relevant information you provide to TIS to support your dispute and reinvestigate the disputed information at no cost. Upon receipt of your properly submitted information, TIS has 30 calendar days to complete our investigation and we will email or mail you a copy of your report. If our reinvestigation findings differ from the original report, we will immediately also send the employer who ordered the report the updated results.

To expedite the process and provide you with the best service, we ask that you complete the following Consumer Dispute & Reinvestigation form and submit it to us by email, mail or fax. Or if you would prefer you can contact us by phone but please be ready to supply the information detailed on the form that we’ll need to begin the reinvestigation process.

If the Reinvestigation does not Resolve Your Dispute

Statement of Dispute

If the reinvestigation does not resolve your dispute, you are entitled to file a brief statement of 100 words or less setting forth the nature of the dispute, providing a clear summary of the dispute. Unless there are reasonable grounds to believe that it is frivolous or irrelevant, TIS will include the statement provided in any future report that contains the disputed information.

Reinvestigation Process Description Request

Upon request, TIS will provide you with more information about the reinvestigation process including:

  • A description of our procedures used to ensure accuracy and completeness of information
  • The business contact information of the data source providers (furnishers) who provided the data in the report and/or reinvestigation

Reporting an Expunged Record

TIS does not report expunged records. Expunged records should be removed from all databases that report criminal records by the providers of criminal record information (courts) as they are not reportable by law. However, there could be a timing issue where the report was completing while the expungement was still in process. If you believe the background check is reporting an expunged record please send TIS:

  • An expungement order signed by a Judge, along with
  • The Consumer Dispute & Reinvestigation Form

TIS does not play any role in the process of expunging records. Please contact the court in which the offense occurred for information regarding the expungement process. Each jurisdiction has its own guidelines for determining which types of records may be expunged or if expungements are available.

Requesting a Full File Disclosure

Per the FCRA, you may request and obtain all the information about you in the files of a consumer reporting agency (your “file disclosure”). You will be required to provide proper identification, which will include your Social Security number. You are entitled to a free file disclosure if:

  • a person has taken adverse action against you because of information in your credit report;
  • you are the victim of identity theft and place a fraud alert in your file;
  • your file contains inaccurate information as a result of fraud;
  • you are on public assistance;
  • you are unemployed but expect to apply for employment within 60 days

However, at TIS we believe it’s our obligation to serve consumers as well as employers, so we are happy to provide a free file disclosure, if requested, after valid identification.

Please note that TIS does not maintain a database of consumer information. We perform background checks for employment or other permissible purposes using public record information, national databases, etc. only after the user of the background check has gained compliant written consent from the consumer/applicant.
